Pursuant to Article 59 of the Law on Local Self-Government (Official Gazette of the Republic of Srpska, No. 97/16 and 36/19), Article 69 of the Statute of the Municipality of Ljubinje (Official Gazette of the Municipality of Ljubinje, No. 3/17), the Decision on the method and conditions of sale of construction land, No. 01-477-4/24 dated April 9, 2024, and Articles 7, 9, and 10 of the Regulations on the Procedure for Public Tender for Disposal of Real Estate Owned by the Republic of Srpska and Local Self-Government Units (Official Gazette of the Republic of Srpska, No. 20/12), the Mayor of the Municipality of Ljubinje announces
PUBLIC NOTICE
on the sale of construction land owned by the Municipality of Ljubinje through public auction
OBJECT OF SALE AND PURPOSE
The Municipality of Ljubinje, Svetosavska Street No. 2, announces the sale of construction land (real estate) marked as plot No. 400/6, with an area of 524 m², registered in the property register No. 562 KO Ljubinje, owned by the Municipality of Ljubinje in the full ownership share of 1/1, without any registered encumbrance.
CONDITIONS FOR THE SALE OF REAL ESTATE AND THE DEPOSIT PROCEDURE
The sale of real estate will be conducted through oral public bidding (auction).
The primary criterion for selecting the most favorable bidder is the highest offered price achieved during the public auction procedure. The public auction will be conducted by a Commission appointed in accordance with the Regulations on the Procedure for Public Tender for Disposal of Real Estate Owned by the Republic of Srpska and Local Self-Government Units (Official Gazette of the Republic of Srpska, No. 20/12). The property cannot be sold at the auction unless at least two (2) bidders with valid applications participate.
To participate in the auction, bidders must pay a deposit of 1,000.00 KM to the Municipality of Ljubinje’s account, number 5674338200000109, with the reference number 02-477-4-1/24, no later than the day set for the auction.
Upon completion of the auction process, after obtaining the opinion of the Republic of Srpska’s Legal Office, the Mayor will conclude a purchase agreement with the most favorable bidder. The agreement will be in the form of a notarized document and will regulate the mutual rights and obligations of the parties. The successful bidder must pay the entire amount of the agreed purchase price, minus the deposit, no later than the day of concluding the sale agreement before the notary. The handover of the property to the buyer will take place no later than 15 (fifteen) days after the payment of the purchase price.
If the bidder whose offer is selected as the most favorable withdraws from the offer or from concluding the sale agreement for any reason, they will lose the right to a refund of the deposit, and the sale agreement will be offered to the next most favorable bidder.
The deposit paid by a bidder who is not selected as the most favorable will be refunded within 8 (eight) days from the conclusion of the public bidding process.
PRICE OF THE PROPERTY
The starting price of the property being sold through the public auction is 1,572.00 KM, as determined by the expert opinion of the permanent court expert in civil engineering and architecture, Mr. Dragomir Brnjoš from Trebinje, made on April 8, 2024.
Bidders must adhere to the bidding limits, and each subsequent bid must be at least 200 KM and no more than 500 KM higher than the last offered bid.
ELIGIBILITY TO PARTICIPATE
All legal and physical persons are eligible to participate in the public bidding process. Bidders are required to bring:
For individuals: certified copy of the ID card
For legal entities: an up-to-date extract from the court registry, original or certified copy, and a certified copy of the ID card of the legal representative
A power of attorney if the legal entity is represented by an authorized person, along with a certified copy of the authorized person’s ID card
Proof of deposit payment
DATE AND LOCATION OF THE AUCTION
The public auction for the sale of the property will be held on May 8, 2024, at 12:00 PM at the Municipality of Ljubinje premises.
OTHER
The documentation and inspection of the property being sold can be viewed on business days from 10:00 AM to 1:00 PM during the advertisement period, with prior notification at the phone number 059/630-280.
The advertisement for the sale of the property from Article 1 of this notice will be published in the daily newspaper Glas Srpske, on the notice boards, and on the Municipality of Ljubinje’s website.
The Municipality of Ljubinje bears no costs for the bidders in this notice and reserves the right to cancel this notice without any liability to participants in the public bidding process.
