Based on Article 59 of the Law on Local Self-Government (Official Gazette of the Republic of Srpska, No. 97/16 and 36/19), Article 69 of the Statute of the Municipality of Ljubinje (Official Gazette of the Municipality of Ljubinje, No. 3/17), the Decision on the Manner and Conditions of Sale of 1/2 of Construction Land (Real Estate), No. 01-022-133/23 dated 07.12.2023, and Articles 4, 7, 9, 10, and 11 of the Rulebook on the Public Tender Procedure for the Disposal of Real Estate Owned by the Republic of Srpska and Local Self-Government Units (Official Gazette of the Republic of Srpska, No. 20/12), the Mayor of the Municipality of Ljubinje announces the following:
PUBLIC ANNOUNCEMENT
on the Sale of 1/2 of Construction Land (Real Estate) Owned by the Municipality of Ljubinje
through Public Auction – Bidding
1. SUBJECT OF SALE AND PURPOSE
The Municipality of Ljubinje, located at Svetosavska Street No. 2, announces the sale of 1/2 of a construction land plot (real estate), consisting of a residential building with an area of 109 m², a single-story structure, and a yard of 187 m², making a total plot area of 296 m². The property is registered under cadastral parcel number 1450, recorded in the Real Estate Register No. 778 KO Ljubinje, owned by the Municipality of Ljubinje to the extent of 1/2, without any registered encumbrances.
2. CONDITIONS OF SALE AND DEPOSIT PAYMENT METHOD
The sale of the real estate will be conducted through an oral public auction (bidding).
The main criterion for selecting the most favorable bidder is the highest price offered during the public auction. The auction procedure will be conducted by a Commission appointed by the Mayor in accordance with the Rulebook on the Public Tender Procedure for the Disposal of Real Estate Owned by the Republic of Srpska and Local Self-Government Units (Official Gazette of the Republic of Srpska, No. 20/12). The property cannot be sold at the auction unless at least two (2) bidders with valid applications participate.
To participate in the auction, bidders must deposit a guarantee of 1,000 KM into the account of the Municipality of Ljubinje, account number 5674338200000109, with reference number 02-477-1/24, no later than the day designated for the auction.
After the auction is concluded, and following the opinion of the Republic of Srpska Attorney’s Office, Deputy Office Trebinje, the Mayor will sign a real estate purchase agreement with the highest bidder. The agreement will be notarized and will regulate the mutual rights and obligations of the contracting parties. The highest bidder must pay the full purchase price, reduced by the deposit amount, within five (5) days from the date of signing the purchase agreement with the notary. The property will be handed over to the buyer no later than fifteen (15) days from the date of full payment.
If the highest bidder withdraws from their offer or refuses to sign the purchase agreement for any reason, they forfeit the right to a refund of the deposit, and the purchase agreement will be offered to the next highest bidder. Participants who are not selected as the highest bidder will receive a refund of their deposit within eight (8) days from the conclusion of the auction.
The buyer must, within 180 days from the date of signing the purchase agreement, put the property to its intended use, meaning they must restore the neglected residential building to a condition that does not pose a risk to public safety or property. If the buyer fails to do so within the prescribed period, the purchase price will be refunded without any deposit, interest, or other compensation, and the purchase agreement will be terminated.
3. PROPERTY PRICE
The starting price for 1/2 of the real estate offered for sale through public auction is 9,126.00 KM. This price was determined by the expert evaluation and opinion of the permanent court expert in construction and architectural fields, Dragomir Brnjoš from Trebinje, dated 03.08.2022, and revised on 01.12.2023.
Bidders must adhere to the bidding increment limits, with each subsequent offer increasing by a minimum of 50 KM and a maximum of 150 KM from the last bid.
4. RIGHT TO PARTICIPATE
All legal and natural persons have the right to participate in the auction process. Bidders are required to provide the following documents:
For natural persons: a certified copy of an ID card
For legal entities: a current extract from the court register (original or certified copy) and a certified copy of the legal representative’s ID card
If a legal entity is represented by an attorney, a notarized power of attorney and a certified copy of the attorney’s ID card
Proof of deposit payment
5. DATE AND PLACE OF THE AUCTION
The public auction for the sale of the real estate will be held on 16.02.2024 at 12:00 PM in the premises of the Municipality of Ljubinje.
6. ADDITIONAL INFORMATION
The documentation and the real estate subject to sale can be inspected on working days from 10:00 AM to 1:00 PM during the announcement period, upon prior registration via phone number 059/630-280.
The public announcement for the sale of real estate, as stated in Article 1, will be published in the daily newspaper Glas Srpske, on municipal notice boards, and on the official website of the Municipality of Ljubinje.
The Municipality of Ljubinje does not cover any expenses incurred by bidders in relation to this announcement and reserves the right to cancel the announcement without any liability toward the participants in the auction process.
